Antenuptial agreements are agreements (a contract) that are made prior to the marriage. Antenuptial agreements are also commonly referred to as prenuptial or premarital agreements. This is an agreement that outlines what is to occur at the dissolution (divorce or Decree of Separate Maintenance) of marriage. However it should be noted that antenuptial agreements poorly written, may be attacked later, and could potentially be found unenforceable by the Family Court.
It is important to have an experienced family law lawyer who is well versed in antenuptial agreements when either drafting one in contemplation of marriage; or, in attacking one while going through a divorce or other litigation in the Family Court.
